1. Agreement to Terms

By accessing or using the Take n Run platform at taken.run (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Platform.

These Terms constitute a legally binding agreement between you and Interesantumi SIA (“we,” “us,” or “our”), a company registered in the Republic of Latvia (registration number 42103102653).

2. Service Description

Take n Run is an interactive photo scavenger hunt game platform. The Platform enables:

  • Game Organizers to create and manage scavenger hunt games by configuring checkpoints (picture targets and locations), inviting players, and reviewing submissions in real time.
  • Players to join games and participate by navigating to checkpoints and submitting check-in photos.

Games are purchased through web shop. The game platform itself does not process payments.

3. Eligibility

  • You must be 18 years of age or older to purchase a game or act as a game organizer.
  • Players under 13 years of age may participate in games only under the direct supervision of a parent or legal guardian.
  • By using the Platform, you represent that you meet the applicable age requirements.

4. Accounts & Access

The Platform uses a UUID-based access model rather than traditional user accounts:

  • Organizer access is granted via a unique creator link. The organizer is responsible for sharing this link only with trusted co-organizers.
  • Player access is granted via a unique game link. The organizer is responsible for distributing this link to intended players.
  • Anyone with the link can access the corresponding game functions. You are responsible for keeping your access links secure and sharing them only with authorized individuals.

5. Game Creation & Rules

5.1 Game Configuration

Organizers may configure games within the following Platform limits:

Maximum checkpoints 50 per game (4 for trial games)
Maximum players The game allows up to 50 players (10 for trial games)
Maximum teams The game allows up to 30 teams (3 for trial games)
Maximum duration 48 hours
Default duration 3:00 h:m (adjustable by organizer)
Penalties Configurable from 5 to 60 minutes, in 5-minute increments (default: 30 minutes)
Maximum check-in attempts 5 submissions per player per checkpoint

6. User-Generated Content

6.1 Ownership

You retain ownership of all content you submit to the Platform, including photos, messages, and feedback (“User Content”).

6.2 License Grant

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to:

  • Use, display, and store your content as necessary to operate the game (e.g., displaying check-in photos to organizers and other players).
  • Include in the public gallery select checkpoint photos, but only when the game organizer has enabled the consent option for their game.
  • Use for Platform improvement and marketing, but only with appropriate consent as described in our Privacy Policy.

6.3 Content Standards

You agree that your User Content will not:

  • Contain illegal, harmful, or offensive material.
  • Infringe on any third party’s intellectual property or privacy rights.
  • Contain malware or any form of malicious code.

We reserve the right to remove User Content that violates these standards.

7. Organizer Responsibilities

As a game organizer, you acknowledge and agree that:

  • You are responsible for the safety and conduct of your game, including selecting safe checkpoint locations and communicating rules to players.
  • You are responsible for ensuring player content and behavior is appropriate.
  • You are responsible for sharing access links only with authorized individuals.
  • Interesantumi SIA is solely a developer and provider of the game platform, bearing no responsibility for any aspects of the games. All inquiries or concerns regarding a specific game should be addressed to the game organizer.

8. Player Responsibilities

Each game has its own set of responsibility guidelines, customized by the organizer. Players must review and accept these guidelines when joining a game.

By participating in any game, you also agree to:

  • Comply with all applicable local laws and regulations.
  • Not submit inappropriate, offensive, or illegal content.

You participate in games at your own risk. Physical activities involved in scavenger hunts (walking, running, navigating urban areas) carry inherent risks. Exercise appropriate caution and judgment.

9. Acceptable Use

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any applicable laws.
  • Harass, threaten, or intimidate other users.
  • Attempt to gain unauthorized access to the Platform, other users’ data, or related systems.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Interfere with or disrupt the Platform’s operation, servers, or networks.
  • Use automated tools (bots, scrapers) to access the Platform without our permission.
  • Circumvent any security measures or access restrictions.
  • Impersonate another person or entity.

10. Intellectual Property

  • The Platform, including its code, design, logos, and documentation, is owned by Interesantumi SIA and protected by applicable intellectual property laws.
  • You may not copy, modify, distribute, or create derivative works based on the Platform without our express written permission.
  • User Content remains the property of the respective users, subject to the license granted in Section 6.

11. Third-Party Services

The Platform integrates with third-party services including Pusher (real-time communication), Google Maps (mapping), and analytics/advertising services (Google Analytics, Facebook). Your use of these services through the Platform is subject to their respective terms of service and privacy policies.

We are not responsible for the availability, accuracy, or content provided by third-party services.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  • WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR AVAILABILITY OF THE PLATFORM.
  • WARRANTIES THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  • OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC GAME GIVING RISE TO THE CLAIM.
  • IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.
  • WE ARE NOT LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES SUSTAINED DURING GAME PARTICIPATION. PLAYERS PARTICIPATE AT THEIR OWN RISK.

14. Indemnification

You agree to indemnify, defend, and hold harmless Interesantumi SIA, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney’s fees) arising out of or related to:

  • Your use of the Platform.
  • Your User Content.
  • Your organization of or participation in games.
  • Your violation of these Terms.
  • Your violation of any applicable law or regulation.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of Latvia, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Platform shall be resolved in the competent courts of the Republic of Latvia.

Nothing in these Terms limits any mandatory consumer protection rights available to you under the laws of your state of residence.

16. Data Cleanup & Deletion

Game data is automatically cleaned up after a game ends:

30 days after game ends Check-in photos, messages, player feedback, tracking events, and non-gallery checkpoint photos are permanently deleted.
180 days after game ends All remaining game data (summary, scores, standings, player records) is permanently deleted.
Gallery photos Checkpoint photos selected for the public gallery (with organizer consent) are preserved beyond the standard cleanup periods.

Games may also be deleted earlier at our discretion or if access is terminated.

17. Termination

  • We may suspend or terminate your access to the Platform at any time if you violate these Terms, without prior notice.
  • Upon termination, your right to use the Platform ceases immediately.
  • Game data associated with a terminated account may be deleted.
  • Sections that by their nature should survive termination (including Sections 6.2, 12, 13, 14, 15, and 16) will survive.

18. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will update the “Last Updated” date and make reasonable efforts to notify users (such as a prominent notice on the Platform).

Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Platform.

19. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and Return Policy, constitute the entire agreement between you and Interesantumi SIA regarding your use of the Platform.
